TENNESSEE: A RESOURCE GUIDE TO PREPARE FOR IMPLEMENTATION ANTI-TRANSGENDER H.B. 1/S.B. 1

This guide will be updated as new information & resources are available.

We know this is a very challenging time filled with many questions. This resource guide is designed to provide up-to-date information and concrete resources to help transgender youth continue accessing healthcare. We will update this guide as more information and resources become available. 

What does H.B. 1/S.B. 1 say?

On March 2, 2023, Tennessee Governor Bill Lee signed into law H.B. 1/S.B. 1, legislation that prohibits gender-affirming healthcare in Tennessee for people under the age of 18; this means that care such as gender-affirming hormone therapy and puberty blockers are inaccessible in Tennessee for any trans person until they turn 18. Youth can still access mental health care, which is not restricted or banned by this law.

This is an evolving area of law and the bill is intentionally vague when it comes to what exactly is prohibited as well as how it is enforced. The bill language does not say that people cannot leave Tennessee and access care in states where it is legal to do so, and a court would likely agree that it is unconstitutional to block people from traveling to other states.

What is H.B. 2310/S.B. 2782, the  2024 Amendment to Tennessee’s ban on gender-affirming care for minors?

On April 25th, 2024 the Tennessee legislature approved H.B. 2310/S.B. 2782, an amendment to H.B. 1/S.B. 1 that seeks to complicate the ability of transgender youth to access gender-affirming medical care out-of-state. Importantly, parents of transgender youth can still access gender-affirming care out-of-state for their children. The bill says that it is not legal for a person or group to intentionally recruit, harbor, or transport a youth under the age of 18 who is living in Tennessee for the purpose of getting them gender-affirming care out-of-state, without the permission of the youth’s parent or legal guardian. The bill does not apply to a parent or legal guardian or an adult to whom a parent or legal guardian has granted permission to assist their child in accessing gender-affirming care out-of-state. It also does not apply to businesses that provide transportation, like ride apps, bus companies or airlines.

When does the gender-affirming care ban take effect?

H.B. 1/S.B. 1 is currently in effect. H.B. 2310/S.B. 2782 will take effect July 1, 2024.

Timeline of Litigation Challenging H.B. 1/S.B. 1 in Court

  • On April 20th, 2023, the ACLU, Lambda Legal, the ACLU of TN, and private counsel filed a lawsuit on behalf of courageous families and young people stating that H.B. 1/S.B. 1 unlawfully discriminates against transgender people based on their sex. Read more about the case here.
  • On April 26, 2023 the United States Department of Justice announced that it is challenging H.B. 1/S.B. 1 in Tennessee. According to the Justice Department, H.B. 1/S.B. 1 violates the Fourteenth Amendment's Equal Protection Clause, as it “denies necessary medical care to youth based solely on who they are.” The Justice Department also asked the court to issue an immediate order preventing H.B. 1/S.B. 1 from going into effect on July 1.   • On June 28, 2023, H.B. 1/S.B. 1 was blocked from taking effect by a federal judge. However, on July 8, 2023, the U.S. Court of Appeals for the Sixth Circuit issued a ruling allowing the ban on gender-affirming care in Tennessee to take effect. This decision is preliminary – the panel of judges indicated that a full ruling on the injunction would come before September 30 – but for now, trans youth cannot access gender-affirming care in the state. See below for how to get help. 
  • In November 2023, a separate petition was filed to the Supreme Court on behalf of families and medical providers challenging Tennessee's ban on gender-affirming health care for transgender people under 18. The case is set to be heard by the Supreme Court, and that ruling will have implications for Tennessee’s gender-affirming care ban and bans in other states.

Que dice H.B. 1/S.B. 1?

El 2 de marzo, el gobernador de Tennessee Bill Lee convirtio en ley la H.B. 1/S.B. 1, legislación que prohibe atención medica relacionada con ser transgénero en Tennessee para personas menores de 18 años; esto significa que cuidados como terapia hormonal de reafirmación de género y bloqueadores puberales serían inaccesibles en Tennessee para cualquier persona transgénero hasta que cumplan 18 años. Los jóvenes aún pueden obtener acceso a cuidados de salud mental, la cuál no es restringida ni prohibida por esta ley en Tennessee.
